Boating DUI: operating a boat drunk is a crime in every state
A boating DUI, or BUI, is a crime in every state and under federal law. The limit for a recreational boat is the same 0.08 as on the road.

Boating under the influence: the federal law
Boating under the influence is illegal on every body of water in the US. The Coast Guard says it is illegal to operate a boat while under the influence of alcohol or drugs in every state, and that it also enforces a federal law against BUI (USCG boating safety).
Under the federal rule, a person running a recreational boat is under the influence at a BAC of .08 percent or more (33 CFR 95.020). The federal penalty is a civil fine of up to $5,000, or a class A misdemeanor (46 U.S.C. 2302(c)).
State BUI laws
Most arrests on lakes and rivers are made under state law, by state wildlife or marine officers. The federal rule does not stop a state from enforcing its own boating law. In Texas, for example, being intoxicated while operating a watercraft is a Class B misdemeanor with at least 72 hours in jail, the same level as a first DWI on the road (Tex. Penal Code 49.06).
How a boating DUI counts toward a later DWI
A boating conviction can follow you onto the road. In Texas, a later DWI becomes a Class A misdemeanor with at least 30 days in jail if you were convicted once before of operating a watercraft while intoxicated (Tex. Penal Code 49.09). Ask whether your state does the same.
If you were charged on the water
A BUI case starts the same way as a car DUI: an arrest, a breath or blood test, and a court date. Ask a lawyer whether your state treats it as a prior and whether it touches your driver’s license. Call for a free review, and a DUI defense lawyer for your state looks at the charge.
People also ask
What is the BAC limit for driving a boat?
0.08 for a recreational boat under the federal rule, the same as for a car in most states. Many states set the same number in their own boating law.
Is a boating DUI the same as a car DUI?
It is a separate charge, often called BUI or BWI. In some states, Texas among them, it counts as a prior for a later car DUI.
Who enforces boating under the influence?
The Coast Guard on federal waters, and state wildlife or marine officers and local police on state waters. Each can arrest for BUI.
Does BUI apply to kayaks and canoes?
The Coast Guard says the federal law covers all boats, from canoes and rowboats to the largest ships.
